Resolving Disputes Through Mediation
Mediation is a confidential, voluntary process where a neutral third-party mediator facilitates productive dialogue between disputing parties to help them reach a mutually acceptable resolution. Unlike litigation, mediation empowers the parties to maintain control over the outcome while working collaboratively to find creative solutions that meet everyone's interests.
Picking the right mediator is essential for a productive mediation. Matt Bartle brings to the table over three decades of experience litigating and arbitrating cases in the Kansas City area and nationwide. He has represented both plaintiffs and defendants in commercial disputes, product liability disputes and investment loss cases pending before FINRA. Mediation Process
Matt tailors his mediation process to fit the needs and requests of the parties to the dispute he is attempting to help resolve. In general, however, the process could include the following:
- Initial Consultation: Each party meets privately with Matt to discuss their concerns, goals, and expectations for the mediation process.
- Joint Opening Session: All parties gather together as Matt explains the ground rules, confidentiality agreements, and process overview.
- Opening Statements: Each party presents their perspective on the dispute without interruption, allowing everyone to understand the full scope of issues.
- Issue Identification: Matt helps parties identify and prioritize the specific issues that need to be resolved.
- Private Caucuses: Matt meets separately with each party to explore interests, discuss potential solutions, and facilitate productive negotiations.
- Joint Problem-Solving: Parties reconvene to discuss potential solutions, negotiate terms, and work toward mutually acceptable agreements.
- Agreement Drafting: If resolution is reached, Matt helps draft a written agreement outlining the terms and commitments made by each party.
